Welcome to Arc. These Terms of Service ("Terms") govern your use of the Arc mobile application ("App") operated by Martin Condet ("we", "us", or "our"), an individual based in France.
By downloading, accessing, or using Arc, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use Arc. By using the App, you represent that you meet this age requirement. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
2. Account Registration
You may use Arc anonymously or sign in with Apple. If you create an account:
- You are responsible for maintaining the security of your account
- You are responsible for all activities under your account
- You must provide accurate information
- You must notify us immediately of any unauthorized access
3. The Arc Experience
Arc enables you to create intentional transformation periods ("Arcs") with defined rules, daily practices, milestones, and a conquest. Key features include:
- Rules: Commitments of what you won't do during your Arc
- Dailies: Practices you commit to perform every day
- Photo Documentation: Before photos and daily check-in photos
- Shadow Days: Up to 3 imperfect days allowed per Arc
- Mentors: Historical figures providing daily wisdom
- Public Arcs: Optional sharing in the Discover feed
4. Arc Credits & Payments
4.1 Free First Arc
Your first Arc is free, sponsored by the founder. Subsequent Arcs require Arc credits.
4.2 Purchasing Credits
Arc credits are purchased as consumable in-app purchases through Apple's App Store. Available packages:
- 1 credit ($9.99 USD)
- 3 credits ($29.99 USD)
- 10 credits ($99.99 USD)
4.3 Patron Model
Each purchase also sponsors credits for other users in a queue. The identity of your sponsor may be revealed to you when you receive a sponsored credit.
4.4 Refunds
All purchases are processed by Apple. Refund requests must be submitted through Apple's App Store. We do not process refunds directly. Once an Arc credit is used to start an Arc, it cannot be refunded.
5. User Content
5.1 Your Content
You retain all rights to the content you create, including photos, reflections, and Arc details. By using Arc, you grant us a limited license to store, process, and display your content solely to provide the App's functionality.
5.2 Public Content
If you choose to make your Arc public, other users can view your Arc name, progress, and send you preset encouragements. You can change your Arc's visibility at any time.
5.3 Content Standards
You agree not to post content that:
- Is illegal, harmful, or violates others' rights
- Contains nudity or sexually explicit material
- Promotes violence, discrimination, or hatred
- Infringes intellectual property rights
- Contains spam or malicious content
6. Accountability Contacts
You may add contact names for personal accountability purposes. These contacts:
- Are stored locally on your device only
- Are never uploaded to our servers
- Will never be contacted or notified by us
7. Acceptable Use
You agree not to:
- Use the App for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Interfere with other users' experience
- Reverse engineer or attempt to extract source code
- Use automated systems to access the App
- Impersonate others or misrepresent your identity
8. Termination
8.1 By You
You may delete your account at any time through the App's settings. Upon deletion, your data will be permanently erased immediately.
8.2 By Us
We may suspend or terminate your account if you violate these Terms or engage in conduct that harms other users or our services. We will provide notice when possible.
9. Disclaimers
Arc is provided "as is" without warranties of any kind. We do not guarantee that the App will be uninterrupted, secure, or error-free. Arc is a tool for personal development and is not a substitute for professional medical, psychological, or therapeutic advice.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Arc, including loss of data, profits, or goodwill.
Our total liability shall not exceed the amount you paid us in the 12 months preceding any claim.
11. Governing Law
These Terms are governed by the laws of France, without regard to conflict of law principles. For EU residents, this does not affect your statutory consumer rights under local law.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use after changes become effective constitutes acceptance of the new Terms.
